Member and Guest Waiver & Release of Liability
All members and guests must complete this waiver before accessing Race Auto Cave or participating in any club-related activities or events.
Acknowledgment and Assumption of Risk
You understand that participation in any activity at Race Auto Cave (“RAC”) involves inherent risks, including but not limited to the risk of personal injury, property damage, or death. You voluntarily assume full responsibility for all risks arising out of or related to my presence at or participation in any RAC activity. You confirm that You are 21 years of age or older.
Release and Waiver of Liability
In consideration of being permitted to access RAC’s facilities or participate in club activities, You hereby release and discharge TK Race Enterprise, LLC d/b/a Race Auto Cave, along with its owners, officers, employees, agents, contractors, and affiliates, from any and all liability, claims, demands, or causes of action—whether known or unknown—arising from any injury, illness, property loss, or other damages that may result from my participation, whether caused by negligence or otherwise.
Indemnification
You agree to indemnify, defend, and hold harmless RAC and its representatives from and against any claims, liabilities, damages, or expenses (including attorneys’ fees) arising out of or related to my actions, omissions, or participation in any RAC activity or event.
Medical Treatment Authorization
You consent to receive medical treatment deemed necessary in the event of injury, accident, or illness while on RAC premises. You understand that You am solely responsible for all costs associated with such treatment.
Photography and Media Release
You grant RAC permission to use photographs, video recordings, or other media taken during events or while on the premises for marketing, promotional, and commercial use. This includes social media, websites, print, and other formats.
Governing Law
This Waiver and Release is governed by the laws of the State of Nebraska. Alcohol is not sold or manufactured on the premises of Race Auto Cave.
Acknowledgment of Understanding
By entering our location facility and surroundings, you confirm that You have read and understood this waiver, that You am voluntarily participating, and that You agree to the terms outlined above.
